Measures restricting freedom include physical restraints restricting movement and treatment without consent according to the Swiss Civil Code. Patients incapable of consenting to treatments and other measures of care and who are somatically multimorbid in addition to their mental illness are frequently encountered in the geriatric psychiatry inpatient setting. In this group of patients, physical restraints are repeatedly used to prevent falling and to quarantine patients due to infectious diseases. Frequently, treatment is conducted with the apparent agreement of the patient but which are to be recorded as measures restricting freedom due to the inability to give informed consent. The National Association for Quality Development in Hospitals and Clinics (ANQ) has introduced geriatric psychiatry as a separate department category; this differentiation should also be seen as an opportunity and invitation to take a differentiated look at measures restricting freedom in geriatric psychiatry.
Titel: Freiheitsbeschränkende Massnahmen in der Alterspsychiatrie.
Einleitung: Freiheitsbeschränkende Massnahmen (FbM) umfassen bewegungseinschränkende Massnahmen und die Behandlung ohne Zustimmung (BoZ) entsprechend dem Schweizerischen Zivilgesetzbuch (ZGB). In der stationären Alterspsychiatrie werden häufig nicht urteilsfähige Patientinnen und Patienten behandelt, die neben der psychischen Erkrankung somatisch multimorbid sind. Bei dieser Patientengruppe kommen wiederholt bewegungseinschränkende Massnahmen zur Sturzprävention und Isolationen aufgrund von Hygienevorschriften bei Infektionskrankheiten zum Einsatz und es werden BoZ durchgeführt, die von den Betroffenen ohne erkennbare Ablehnung toleriert werden, die aber wegen der fehlenden Zustimmung als FbM zu erfassen sind. Der Nationale Verein für Qualitätsentwicklung in Spitälern und Kliniken (ANQ) hat die Alterspsychiatrie neu als eigene Klinikkategorie eingeführt. Wir nehmen dies als Anlass, insbesondere auch FbM in dieser Klinikkategorie differenziert zu betrachten. Introduction: Les mesures restreignant la liberté (ML) comprennent les mesures restreignant la liberté de mouvement et le traitement sans consentement (TSC), conformément au code civil suisse. En psychiatrie de la personne âgée hospitalière, on traite souvent des patientes et des patients incapables de discernement qui, outre leur maladie psychique, sont multimorbides sur le plan somatique. Dans ce groupe de patients, on recourt de manière répétée à des mesures restrictives pour prévenir les chutes et à des isolements en raison des consignes d’hygiène en cas de maladies infectieuses. On réalise des TSC qui sont tolérés par les personnes concernées sans refus apparent, mais qui doivent néanmoins être saisis comme TSC en raison de l’absence de consentement. L’Association nationale pour le développement de la qualité dans les hôpitaux et les cliniques (ANQ) a introduit la psychiatrie de la personne âgée comme un type de clinique à part entière. Cette différenciation doit également être considérée comme une opportunité et une invitation à considérer de manière différenciée les ML dans cette catégorie.
