Family empowerment, an alternative to guardianship. Introduced on 1 January 2016, the family empowerment remains unknown to the general public as well as health professionals. This new system of legal protection allows a relative (descendant, ascendant, brother or sister, concubine, partner of Pacs, spouse) to represent a person who is no longer able to express his / her will. Simpler in implementation and in day-to-day management, family empowerment can be an alternative to guardianship. Although family empowerment has many advantages, it has one major disadvantage: the absence of control of the acts performed by the agent. The opening of a family empowerment measure requires good understanding and benevolence among all members of the family.
L'habilitation familiale, une alternative à la tutelle. Entrée en vigueur le 1er janvier 2016, la mesure d’habilitation familiale reste encore mal connue du grand public comme des professionnels de santé. Ce nouveau dispositif de protection juridique permet à un proche (descendant, ascendant, frère ou soeur, concubin, partenaire de Pacs, conjoint) de représenter une personne qui n’est plus en capacité d’exprimer sa volonté. Plus simple dans sa mise en oeuvre et dans sa gestion au quotidien, l’habilitation familiale peut être une alternative à la tutelle. Si l’habilitation familiale présente de nombreux avantages, elle présente toutefois un inconvénient majeur : l’absence de contrôle des actes réalisés par le mandataire. L’ouverture d’une mesure d’habilitation familiale nécessite donc une bonne entente et une bienveillance entre tous les membres de la famille.
